Since we are sharing stories of bands inadvertantly stealing each other's
names, I might as well share my friend's story.

My friend started the SoCal band, The Invisible Men, who played locally for a
while before discovering the Pacific Northwest band of the same name (comprised
of ex-Rip Offs, I think)

He wrote them, and they agreed to drop the name, until Estrus approached them
and decided to put out a 7".  They recorded the album and released it under the
Invisible Men.

Weird how these things happen.

Speaking of this, anyone know of bands out there calling themselves The
Ephedrines?  (as my band will be called this if it is not taken)

a few CDs and members have played SXSW as well as toured the country.

If you registered the name, you have legal precedent. If you did not, however, 
it's a harder road. Even though you put records out, the other band could make 
a case that they checked the copyright registry to secure the name (like 
corporations must before officially doing business) and no one had registered 
it. They could then claim that (1) they've been using the name for a long time 
(as you have) and (2) they either never got your letter (what?? Lying during 
legal process??) or ignored it as they knew you had not registered the name 
and therefore had no reason to fear recourse.

I've been troubled by the band name issue for three years now. My band, the
Aquavelvets, released a blue vinyl EP in 1992. A year later, Heyday released
an album by the Aqua Velvets, the surf band from San Francisco. We had never
heard of them, but thought it was pretty funny that two bands would pick this
name (with a slight spelling variation). So I wrote to them, their record
company and their fan club, and sent a copy of our record (which had been
sold through Bomp, Metro and a few other such places). I was really only
trying to avoid trouble.
But they ignored the letters and subsequent faxes. So we proceeded to make a
couple more records and pretty much forgot about the name issue. Now the
other Aqua Velvets are signed to Milan, which is distributed by BMG, which
has lots of marketing muscle. So what do we do? So far, nothing. Who wants to
mess with all this when you should be making music? I just wish those guys
had written back three years ago and threatened legal action so we (being
complete cowards) would have just changed our name before making two more
records, playing lots of shows, printing T-shirts, etc.
Blair says keep the name and forget it. And, hey, if Blair says so, that's
all we need to hear!

You can't register a copyright on a name, phrase or title.  There is no such
thing as a copyright for a band name.  You can copyright intellectual property
only -  the lyrics and music - but never the titles of the songs or the names of
the bands.  You "trademark" words and phrases.  Copyrights are separate
and different from trademarks and the two are subject to entirely different
sections of US law.  And, unlike a copyright, you cannot claim a trademark
until you register it with Patent and Trademark, and you can only register it
after you have already begun using the mark in commerce.

I disagree. Why form your own band if EVERYTHING's been done before? Why 
go through all that hard work and frustration if it's all been done 
before? A new rock band--one that plays original music--is, by its very 
existence, a vessel of hope.

If you're *really* stuck on a band name, there's a Macintosh HyperCard
stack out there called "Name Generator" which can spit out as many names as
you want, need, or care.

As I recall, it can also generate fake science-fiction gadget names too,
such as "magneto-dipolar hydrothruster", "the combustotron", etc.

It's available at all the usual net places (info-mac, etc.)

Reminds me, my friend Matt and I a few years ago were in silly mode
and were coming up with all these dumb names for a female band.  The
metal band (sorry we were obsessed with the 80's too) would be called
BUXXOM (comlete with umlaut), the grunge band would be called TIT and
the garage band would be either THEE MIGHT BOOBICLES or THEE BREASTESES.

Yes, very juvenile and possibly sexist.  Don't flame me, please.

Matt's other idea was FLAG SABBATH, which would combine Black Flag and
Black Sabbath songs (obviously), such as "I Am Family Man" and "Paranoid
Depression".

But I am now waaaaaaayyy off course for the usual bomp list discussions,
possibly?  I've had a long work day and lots o' coffee and just wanted
to see if anyone else there has the same sense of humor as I...

I still stand by what I said earlier, not so much that I've "been there,
done that" (believe me I HAVEN'T), but because I find it hard to believe
that someone, SOMEWHERE hasn't at least THOUGHT of, if not done, whatever
I'm thinking/doing.  Maybe I'm just jaded.

Why form your own band?  Maybe to play music that you love, regardless of
whether or not it's been done before.  My dream is to play 96 tears-style
organ, and I won't kid myself into thinking I'm breaking new ground.  Not
to say that bands out there are kidding themselves -- it's great to see
enthusiastic new and old bands.  I don't know what "original music" would
be.  Do you mean original songs (as in not covers)?  I just think it's
great to see someone up on stage putting 110% and sweating like a damn
pig because he/she loves what he/she is doing!  There's nothing worse than
seeing talented musicians playing in bands to get paid but not really 
enjoying themselves (and unfortunately there are many out there, and some
don't have a choice!).

But yes, Greg, seeing new bands playing original music, or at least music
they -- and I -- love, is a vessel of hope.

The Statics was in The Invisible Men in Seattle... they did some stuff for

Hey, this name thing is not solely confined to the 90s.  There were tons 
of 60s bands that had the same names, even with records out regionally (& 
even nationally).  How many Fugitives, Chosen Fews, Plagues, and more 
were there.  And, there were at least 2 Iguanas, Psychotics, Cryan' (Cryin') 
Shames, Kaleidoscopes, Chocolate Watch Bands, even (there apparently was a 
second band of that name in the U.K.!)

Right-o. Some of the Fall-Outs, too. Their Estrus single is OK, pretty
mediocre. Zappa and Childish covers. Funny you mention the L.A. Invisible
Men. I went to see them open for Servotron, but two of their girlfriends got
mugged and so they didn't play. I think Gregg "Lord" Hunt and Shane from the
Bomboras are in there, right? Ran into them the other day at Barnes'n'Noble.
Oh, w/r/t the new Bomboras singles comp, I think a lot of their singles are
better than their album; (they really sound nothing like that live) they have
a pair of vocals that are shining examples of garage rock. Yessiree. Go buy
that CD from Dionysus. Hooray for bonus tracks. Also, they've got a 10"
coming out in a month or so and an album after that.

I realize it's silly to ask for a favor in my first post to bomp-l, but well,
y'see, the Estrus Invitationals are this Sunday in L.A. and they were just
moved from an all ages venue to Spaceland, which is 21+. Long story short,
I'm 16. Anyone wanna help me get in? I'd be mucho obliged.
