On the same day as the release of his long awaited new spoken word album
"Become The Media", Jello Biafra, the acknowledged leader, visionary,
and main song writer of the now defunct punk pioneers, Dead Kennedys,
takes issue with the highly misleading press release and actions of the
other former band members, and opposes the release of a subpar live
album and rest of the DK back catalog behind his back and without his
permission:

I have now had to ask them to please remove my name and likeness from
all their releases and promotional material.  Don't get me wrong,  I'm
as proud as ever of Dead Kennedys and grateful for how much we mean to
people.  But I m totally embarrassed by what they re trying to do.

I will not support anyone who condones greed and vicious lawsuits to
scam on someone else's art against the wishes of all the artists
involved. Alternative Tentacles will not endorse or carry unauthorized
Dead Kennedys albums in our mail order.  I will not sign them.  I don t
even want them in my collection.

What the ex-Kennedy s are neglecting to tell you is that the jury's
verdict is outrageous and both legally and factually incorrect.  I have
filed a motion for a new trial and will file an appeal.  The court also
found that East Bay Ray had committed fraud and had breached his
fiduciary duty to his partners (including Biafra) in the handling of
Dead Kennedys  royalties, and the jury assessed damages against him.

The Court has found that the underlying intellectual property, including
the compositions and recordings were in fact owned by the individual
members of the band, a point continuously asserted by Biafra and denied
by the rest of the band.

Most importantly, however, the court ordered the Decay Music partnership
wound up and dissolved.  While Ray continues to attempt to market the
band s music, any license will be subject to legal challenge as control
in reality rests with the individual members.

Following are further facts and replies regarding the three ex-DKs
lawsuit and their recent press release :

"So what is this really about?  For over two years we have bent over
backwards to compromise and settle this case.  They reneged and refused.

The plaintiffs  press release also fails to mention that their legal
action came right after Biafra opposed using Dead Kennedys' song,
"Holiday in Cambodia," in a Levi's Dockers TV commercial.  "I was
shocked they would even consider the idea, let alone pressure me to do
it.  Talk about being on the wrong side of an issue.  So many people are
upset with  growing corporate branding and intrusion into our daily
lives, from the WTO to the Buzzcocks' song in an SUV commercial.  I
could think of no worse way to stab Dead Kennedys fans in the back than
to turn around and trash everything we ever stood for and allow one of
our best (and my favorite) songs to be used to sell products by a global
corporation with controversial labor practices.  Dead Kennedys always
stood against things like this." said Biafra.

Yes, there was an honest accounting mistake.  We were all trying to
identify how the discrepancy happened.  Only after I refused to sell out
to Levis did the others bring in lawyers and start making all kinds of
wild accusations.  When we (yes, we) found the discrepancy and totaled
it up, we paid them the money before their lawsuit was even filed.
There was no court order then, and there was no cover-up.  As soon as we
knew the total we told them.  The perpetuity offer was only that - an
offer - waiting for a counter offer where both parties could hopefully
meet in the middle and shake hands.  We thought we were dealing with
reasonable people.

At the trial, Ray, Klaus, and DH went up to the witness stand one by one
and lied.  They claimed they wrote the music to all my songs because,
"Biafra is not a musician."  They claimed I could not possibly have
written anything because I don t play a musical instrument, and worse
yet, don t read sheet music.  (Does this mean the secretary who typed an
author's dictation created the literary work?  No.  How many artists do
you know who teach their songs to the band by humming the parts?  I
still do.  Charlie Chaplin did it with a full orchestra.)  They also
claimed that I somehow sneaked the writing credits by them, and they
never noticed the credits on the albums or their BMI statements for the
last 20 years.  Imagine my shock and disgust to see them say these
things with a straight face.

They also brought in an expert witness from Grateful Dead Records who
claimed I owed Ray, Klaus, and Darren hundreds of thousands in damages
for "failure to promote Dead Kennedys."  What did they ever do?  He
based his conclusions on a cockeyed axiom that if "X" amount more money
had been spent advertising old albums people already know, "X" amount
more CD's would automatically have been sold.  Therefore I should pay a
huge damage sum for albums that don t even exist.

The ex-DK's also demanded damages because their own solo projects did
not sell as well as Dead Kennedys.  That was somehow my fault, too.
Thankfully, the court threw that one out.  The Grateful Dead guy further
claimed I owed damages because Dead Kennedys, who broke up 14 years ago,
were not periodically in Billboard, Rolling Stone, and get this, VH-1.
He admitted he had no experience with underground punk labels.

To my eyes, even the three ex-Kennedy s looked visibly shocked when the
jury verdict was read.  They quickly showed that their intention was not
to milk Dead Kennedys as a "democracy" at all, or even to share the
band's royalties. They filed a motion to expel me from the Decay Music
partnership, so they could pay me a lump sum and then never have to pay
me again.  That motion was denied.

They are now operating their so-called "democracy" so that I have no say
in how they dispose of Dead Kennedys at all.  I was never consulted
about them hiring lawyers and publicists to smear and attack me, let
alone using money they owe me to help pay for it.  Shouldn't I be
allowed a say in whether I help finance legal action against myself?
This is not a democracy.

 I found out about their new attempt to hijack the Dead Kennedys back
catalog not from them, but from the press.

I was only sent a cassette of this supposed live album a few days ago.
They have not allowed me to see the artwork (but "voted" to charge me
for it, of course).  I have also not been informed or allowed any say in
who might be releasing this.

Another example is the censored version of Dead Kennedys' song, "Police
truck" in the Tony Hawk Pro Skateboard game.  The offer originally came
to Alternative Tentacles, and as legally obliged, we copied it to East
Bay Ray.  We never heard from Ray again.  Needless to say I would never
have agreed to any of our songs being censored just to appear in a video
game.  I have no idea what happened to the band's share of the money
either.  At least a hundred people have come up to me and complained
about the censored "Police Truck."

Their live cassette sounds ok, but the performances range from so-so to
just plain bad.  I am especially galled that Ray would take so little
pride in his own work.  There are guitar mistakes in almost every song -
over half a dozen in "Police Truck" alone.  I guess they just don't
care.  It s also obvious I paid more attention to the stage performance
than to the microphone at times.  So needless to say, I don't recommend
it.  If anyone wants to check out live stuff without lining the pockets
of those who support suing their ex-band mates, there's tons of it on
the net already.

As for "democracy" and "sharing," Ray and the others have refused all
requests for a full and proper accounting of Decay Music's books.  They
almost never share copies of any of their correspondence or let me know
what is going on.  All I get are vague statements claiming what they owe
me is deducted for "expenses," but I am never allowed to see what all
those "expenses" are.  No correspondences, no invoices, no statements,
nothing.  Funny how the last check added down to zero.  Ray also
testified in court he has been skimming "commissions" for himself off
whatever comes through the Decay Music account.  He specifically
promised me earlier he would not take "commissions" from me or the
band.  This is not a democracy.

I am not the only person who loves Dead Kennedys enough not to let this
stand.  We have formed the Alternative Tentacles Legal Defense Fund to
help with the enormous costs of the appeal.  The fund can be reached
through Alternative Tentacle s website or mailing address."

sorry to bring this up again, but sadly i haven't paid much attention to all 
the discussions of cd-burners in the past, and now i'm gonna be buying one 
(or two).

first, i'm buying a new computer within days -- either a mac g4 or the 
top-end imac (depends on my cashflow), to replace my old, out of date and 
burnt out quadra, and want to get a cd burner for it -- for both file backup 
and, of course, music fun! i need to know what is my best, though not 
super-expensive, option.

i'm also thinking about getting a burner for my stereo setup (the computer's 
in my office, stereo is home), maybe one that'll double as a player as my old 
pioneer finally bit the dust. i figger i'd primarily be doing vinyl to cd.

any help and recommendations (offlist?) would be oh-so appreciated!!!

The Sun Ra singles CD is a double CD of, uh, Sun Ra singles.  It's on the
Evidence label, 1996. I am a Sun Ra fan, but this is one of my fave releases
of his. Even those not into his more way out jazz stuff may dig a lot of the
early doo-wop and R&B stylings of his earliest singles. Because this is all
singles stuff, the songs tend to be shorter and thus more digestable to the
unitiated. Songs like "Muck Muck" and "Hot Skillet Mama, both recorded w/
"space age vocalist" Yochanan in 1957 have shown up on various R&B comps
over the years. "I'm Gonna Unmask Batman" was recorded in '68 and later
again in'74. 

An aside to this is the "Sensational Guitars of Dan and Dale: Batman and
Robin" LP released on Diplomat in the '60s. It was reissued last year by
Magic City Records and retitled "Sun Ra vs. Dan and Dale." Featuring Sun Ra
along with members of the Blues Project, this wigged-out  mostly instro
offering is definitely worth checking out!

<I only saw the C. Kings play once, in 1986, just after Walter joined the
group on guitar.  The show was good, I even liked the fact that they
were heading in the "...Doomsday" direction.

Are you sure that was '86, because I thought Walt joined them after
"Doomsday" came out in '87! Strangely enough, when I saw them for them in
'88 after "Doomsday" came out, Rick Cona was with them but he didn't play
with them, he was just roadie-ing. I could've sworn that Rick told me it
Walt hadn't been playing with them that long. He did a fine job, too, I
might add.

	Mike is absolutely correct in this. Walt (ex-BBBs, The Swing Set, and The
Insiders, I believe) joined up when Ori left (after a Buffalo - or maybe
Cleveland - show) in early '86. Something puts the time around March in my
mind. 
	Rick and Walt played together in the band till Rick left around June '87.
In fact, the Doomsday record release party (late June or early July '87)
was the first show I saw them do without him. In fact, it was probably the
first one with "Sonic Boy" Mike Pappert (who did an excellent self-released
semi-solo Power Pop/Mod single as The Group Image). When I saw Rick in the
audience before the band was about to go on, I obviously had to ask. At the
time, he just said that he was planning to go live with his girlfriend in
California.
	A year or so later, I ran into him at the Big Kahuna in NYC. I remember
him telling me he'd had offers to join both The Fuzztones and The Lyres at
various points, but wasn't interested.  He did say that the reason he'd
left was that he'd become disillusioned with the band's direction. He also
indicated that Walt was feeling much the same way. (This probably explains
Walt's departure, as well.) Of course, there are many sides to the story.
	A couple years later, Walt and Rick joined forces in a group called The
Pawns. I don't think that lasted too long, tho'.  And now Rick's in
McFadden's Parachute. (Or was last time I heard.)

Prices in Germany are lower c/o of the big chain stores there who 
can rake in the money elsewhere and use low record prices as

affects the entire music-bizz, 'cause other shops have to go along. 
A couple o' years ago Crypt lowered their prices for the German 
market 'cause they could no longer compete, the net result was 
that neither the label nor the bands were makin' any money, you 
think that's good for "new music"?.
I could go on here for ages, but in the end I really couldn't care 
less, if you want your music cheap you can download as much as 
you want these days. Anyways, my main bug still is that you 
quickly grabbed the opportunity to badmouth somebody who's not 
around to defend himself.

  Oh, Thor was in "Rock and Roll Nightmare" as well as "Zombie 
Nightmare".  "Zombie Nightmare" was a feature film on Mystery Science 
Theatre 3000 once.  Both are incredible in that "car wreck movie" way that 
some of us love, myself included.

I didn't realize Thor was still playing!  A friend of mine has a few 
records of his, but I have to say that I cannot listen to them!

Ummm, the situation Vanya describes reminds me a lot
of where I live (Madrid, Spain). There are 2/3 good
record shops totally inaccessible for me. I use to
wonder how they even survive with those prices but I
guess that even if they sell one record, it saves the
whole month. And I am not talking about rare stuff,
but new CD's and Lp's as well, most of which you can
find considerably cheaper 50m away in a less 'cool'
store. I have several theories about it. The main one
is that their clients 10/15 years ago now are all
respectable wealthy middle age men who doesn't mind to
pay more because they can feel closer to those middle
age owners (after all they wear the same clothes) and
laugh at the younger ones when their eyes are open
wide after seeing the prices. Because these gentlemen
wouldn't dare to go near another place, afraid they
would be looked at like old hippies. So that's what
they're paying for. But you're being cheated! Like
when they sell to you those Munster vinyl reissues
like if it was some kind of rare import and they are
released on a Spanish label!!! Buff, and I nearly
worked for one of these shops...(I was the only one
who passed the interview because I was the only one
who knew what power-pop was)

Germany is a bit far for me and still I don't know if
it would be cheap because our currency here is the
lowest of the lowest. I use mail order which kills the
fun of looking around in a shop but it is definitely
cheaper. And it is funny to see how the rise of the
dollar affects some much more than others...

My understanding of the "nasty man" situation is that is actually a certain
Mr. Klein that is involved in what may actually be a very intricate tax
dodge. According to my source it is something to the tune of a million bucks
to have the stuff released.
And really it is pretty unlikely that the LP would ever bring in that kinda
loot no matter how much we dig 'em.

Shame...  Oh, and I've missed alot here lately but I believe there was talk
of the "FAN CLUB" lp?
I have a copy on tape and it is pretty cool. Especially the snarling Kinks
cover I Need You, Gloria, Smokestack Lightnin' and the more beat group
stuff.

I still think the most important stuff is what Scott Morgan is doin' now!
Especially a collection of rarities that is due out soon on Real -O-Mind.  I
was fortunate enuff to see 99% of the reformed Rationals shows back in the
early 90s and there are a couple of tracks they recorded during that period,
Morgan's Jones Bros. work (including a killer version of Al Green's "Full Of
Fire") and other cooooool more R&B related items!

Morgan is a helluva a guy and still kicks it out like few others. Never miss
an opportunity to see him. Ever!

Subject: rutles/pearl jam

by the way, rhino is putting out the rutles dvd soon with the usual lots of
extras---and i know that pearl jam is not the favorite here (although i
thought them with neil young on the grammys a few years back was great) and
neither am I, but these guys not only put out 23 double cd's of every show
they did on their european tour but i just got the new sony book today and
they are puttin out 25 shows from the (first half) of their summer/fall us
tour of 2000---gotta love their accessibility stance---now if only we could
get lyres/c kings/etc shoes like that (do love the standells and monks at
cavestomp by the way)---fiscally unfeasible i'm sure, but........

Didn't see that, but I'll cop to liking a track off the album they did
together that got some airplay here...

    i have been listening to an awful lot of manfred mann lately, talk about 
an underrated band. they are right up there w/ the beatles and the zombies in 
my book...what an original sound! especially on stuff like "i'm your 
kingpin," where their jazz influences come out & they sound like no other 
english (or american, for that matter) band of the time. great band!
    my question is this: i totally dig paul jones' singing & he's a great 
harp player, too. i've noticed that RPM has a couple of CDs out of his solo 
stuff. is any of this worth picking up? didnt he kind of drift off into MOR 
territory?? i think he did a cover of "aquarius," which aint too promising. 
but hope & record buying dollars spring eternal, so can anybody tell me if 
his solo stuff is any good at all?? any advice would be much appreciated - 
i've gone this far w/o owning a record with "aquarius" on it, i'd hate to 
break a 20 year streak for nothing.

some of the solo stuff is pretty lame but there is a great 45 of him doing
harmonica tributes to great bluesmaen (can' think of the name right now but
title is self explanatory)---but definitely check out the Blues Band, at
least 5 lps with tom mcguiness, hughie flint, dave (mys sister was joann)
kelly and another guy---great stuff---happened to see one of their early
gigs at the riverside studios in london in the 80's---dig it
